Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Black Hole ("Black Hole", "we", "us") governing your use of the Black Hole website builder platform, including all features, APIs, and generated content (the "Service").

If you are using the Service on behalf of an organisation, you represent and warrant that you have authority to bind that organisation to these Terms.

Black Hole is an AI-powered website builder. You provide natural-language prompts; Black Hole generates, hosts, and optionally publishes websites on your behalf. The Service includes:

• AI-driven website generation using large language models
• Hosting of generated websites on Black Hole's infrastructure
• A visual workspace for editing and managing your projects
• Publishing to a public URL under a Black Hole subdomain
• An agent mode for advanced agentic website building tasks

You must be at least 13 years old (or the minimum age of digital consent in your country) to use Black Hole. Accounts are personal — you may not share, sell, or transfer your account.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at security@blackwhole.online if you suspect unauthorised access.

Free plan. Free accounts receive a monthly credit allowance. Credits reset at the start of each billing cycle and do not roll over. Unused credits expire.

Pro plan. Pro subscriptions are billed monthly or annually in advance. Subscription fees are non-refundable except where required by applicable law or at our sole discretion within 7 days of purchase.

Credit purchases. Additional credit packs are non-refundable once credits have been consumed.

Price changes. We may change prices at any time. We will give you at least 30 days' notice before price changes take effect for existing subscribers.

You agree not to use the Service to create, distribute, or publish content that:

• Violates any applicable law or regulation
• Infringes the intellectual property rights of any third party
• Is fraudulent, deceptive, or misleading
• Contains malware, phishing, or other malicious code
• Promotes violence, hate speech, or discrimination
• Contains child sexual abuse material (CSAM) — will result in immediate account termination and reporting to authorities
• Constitutes unsolicited commercial messaging (spam)

We reserve the right to remove any content and/or terminate accounts that violate these rules at our sole discretion.

Your content. You retain ownership of all prompts, content, and data you provide to Black Hole. By submitting content you grant us a limited, non-exclusive licence to process and store it solely to provide the Service.

Generated websites. Subject to these Terms, you own the websites Black Hole generates for you. You may export, modify, and publish them freely.

Black Hole brand. The Black Hole name, logo, and trademarks are our property. You may not use them without prior written permission.

AI model outputs. AI-generated content may not be copyrightable in all jurisdictions. We make no warranties regarding intellectual property ownership of AI-generated output.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WARP'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100.

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

You may delete your account at any time in Settings. We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with 30 days' notice (except in cases of serious breach, fraud, or legal obligation).

Upon termination: (a) your right to use the Service ceases immediately; (b) we will retain your data for 90 days after which it is permanently deleted; (c) active subscriptions are cancelled at the end of the current billing period.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute shall be resolved by binding arbitration under the AAA Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
